🔹 Federal Job Protections You Can Count On
Family and Medical Leave Act (FMLA)

If your employer has 50+ employees, and you’ve worked there at least 1 year (1,250+ hours), you may qualify.

FMLA gives you up to 12 weeks of unpaid, job-protected leave for treatment.

You must receive treatment from or through a healthcare provider.

Your employer must restore you to your same or a similar role when you return.

Americans with Disabilities Act (ADA)

If you’re in active recovery, the ADA protects you from being fired or treated unfairly because of your past substance use.

You can request reasonable accommodations (like flexible hours for IOP or using PTO).

Current illegal drug use is not protected — but seeking or completing treatment is.
Other Protections:
